Terms of Service

1. Definitions

  • "Service" / "Guardiso"the ISMS platform available at guardiso.com, including all related applications, APIs, and features.
  • "User"a natural person using the Service who has an account or has been invited to an Organization.
  • "Organization"an entity (company, institution) registered in the Service under which Users collaborate.
  • "Content"any data, documents, policies, risks, controls, evidence, and other materials entered by the User into the Service.
  • "Operator"Guardiso — a sole proprietorship operated by Michal Lewandowski, based in Poland.

2. Account Registration & Responsibilities

To use the Service, you must create an account via Google OAuth authentication. By registering, you represent that:

  • You are at least 18 years old or have parental/guardian consent.
  • The information you provide is truthful and current.
  • You are responsible for the security of your account and all activities performed using it.
  • You will promptly notify the Operator of any unauthorized access to your account.

3. Acceptable Use Policy

By using the Service, you agree not to:

  • Violate applicable law or third-party rights.
  • Upload malicious content, viruses, malware, or other harmful materials.
  • Attempt to gain unauthorized access to systems or other users' data.
  • Use the Service for purposes inconsistent with its intended use (e.g., cryptocurrency mining, scraping).
  • Resell or sublicense access to the Service without the Operator's written consent.
  • Circumvent technical safeguards, rate limits, or Service restrictions.

4. Service Availability

The Operator endeavors to keep the Service available 24/7 with a target availability of 99.9% (SLA). However:

  • The 99.9% SLA guarantee applies only to Enterprise plans with a signed SLA agreement.
  • For free and standard plans, the Operator does not guarantee a specific level of availability.
  • Planned maintenance windows will be communicated with at least 24 hours' advance notice.
  • The Operator is not liable for outages caused by force majeure, DDoS attacks, or infrastructure provider failures.

5. Intellectual Property

The Guardiso Service, including its source code, user interface, documentation, templates, and AI algorithms, constitutes the Operator's intellectual property and is protected by copyright law.

The User receives a limited, non-exclusive, non-transferable license to use the Service in accordance with the selected subscription plan.

6. Data Ownership

The User retains full ownership of all data and content entered into the Service. The Operator claims no ownership rights to User Content.

The User grants the Operator a limited license to process Content solely for the purpose of providing the Service (including AI processing, report generation, and backups).

The User may export their data or request its deletion at any time in accordance with the Privacy Policy.

7. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as-is" without warranty of fitness for a particular purpose.
  • The Operator shall not be liable for indirect, incidental, special, or consequential damages.
  • The Operator's total liability is limited to the amount of subscriptions paid in the last 12 months.
  • AI-generated content (policies, recommendations, analyses) is auxiliary in nature and does not constitute legal advice.

8. Termination

The User may terminate the agreement (delete account) at any time via account settings or by contacting the Operator.

The Operator may suspend or delete a User's account in the event of:

  • Violation of these Terms or the acceptable use policy.
  • Inactivity for more than 12 months (after prior notification).
  • Outstanding subscription payments (after prior notice).

After termination, User data will be retained for 30 days (grace period), then permanently deleted. Backups are purged within 90 days.

9. Governing Law & Jurisdiction

These Terms are governed by Polish law. Any disputes arising from the use of the Service shall be resolved by the competent courts in Poland at the Operator's registered location.

For EU consumers, mandatory consumer protection provisions of the member state of residence also apply.

10. Changes to Terms

The Operator reserves the right to modify these Terms. Users will be notified of material changes via email or in-app notification with 30 days' advance notice.

Continued use of the Service after changes take effect constitutes acceptance. If you disagree with the changes, you may delete your account before they take effect.
